Marriage and House Ownership

Question

I live in Alabama. Married 12 years.
Home is paid for before we married. My name not on deed.
What if the husband dies? My husband is 67 and I am 52.
The house was paid for as it was built.
I am not on the deed. What will happen if he dies first?
Will I be on the street?

Question

This is a situation where the answer can be complex.

If you have children with him, or if he has children that are not yours, it changes the answer.   What you really need to know, is that if he is of sound mind, loves you, and intends for you to have the house, he needs to change the deed NOW.  He can deed it to  himself and you, "Joint with Right of Survivorship", which means if you die first, he owns it, if he dies first, you own it.   If he has some other idea about who should own the house after he has died, other than you, well, that's another matter.
